1. Acceptance of Terms

By accessing or using OutreachBot (“the Service”), operated by OutreachBot (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

OutreachBot is an AI-powered cold outreach platform that discovers leads, researches prospects, generates personalized emails, and tracks campaign performance. The Service sends emails from your connected Gmail account on your behalf.

3. Acceptable Use

You agree to use the Service only for lawful purposes. Specifically, you agree to:

• Comply with the CAN-SPAM Act and all applicable email marketing laws in your jurisdiction
• Not use the Service to send spam, unsolicited bulk email, or deceptive messages
• Not send emails with misleading subject lines or false header information
• Include a valid physical mailing address in your outreach emails
• Honor all unsubscribe requests promptly (the Service handles this automatically)
• Not use the Service to harass, threaten, or send abusive content
• Not attempt to circumvent sending limits, rate limits, or other platform restrictions
• Not resell or redistribute access to the Service without our written consent

Violation of these acceptable use terms may result in immediate suspension or termination of your account without refund.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

5. Gmail Integration

The Service requires OAuth access to your Gmail account to send emails and read replies. By connecting your Gmail account, you authorize us to send emails on your behalf as configured in your campaigns. You may revoke this access at any time through your Google Account settings, which will disable the Service's email sending capability.

6. Billing & Payments

• Subscription fees are billed monthly in advance on the date you subscribe
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with 30 days' notice
• If payment fails, we may suspend your account until the balance is resolved
• You may cancel your subscription at any time; access continues until the end of the billing period
• Unused leads or email credits do not roll over between billing periods

7. Intellectual Property

The Service, including its software, design, and content, is owned by OutreachBot and protected by intellectual property laws. AI-generated email content created through the Service is licensed to you for use in your outreach campaigns. You retain ownership of your business data and campaign configurations.

8. Service Availability

The Service is provided on an “as-is” and “as-available” basis. We strive for high uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, OutreachBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim. This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements, that email deliverability will be guaranteed, or that AI-generated content will be error-free.

11. Account Termination

We may suspend or terminate your account at our discretion if you violate these Terms, engage in abusive behavior, or if required by law. You may terminate your account at any time by contacting support@outreachbot.dev. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination, after which it will be deleted.

12. Indemnification

You agree to indemnify and hold harmless OutreachBot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
